Notice of the Municipality on Certain Issues Concerning Expansion of HPF System Coverage to Include Foreigners, Overseas Returnees with Foreign Permanent (Long-Term) Residence Permits and Residents from Taiwan, Hong Kong and Macau Working in Shanghai has been prepared and implemented as of late,after deliberation and approval by the 48th plenary meeting of Shanghai Housing Provident Fund Management Committee, in a move to efficiently and comprehensively accommodate our practical measures to the new requirements of the central government for speeding up construction of Shanghai as a technology innovation center with global influence, and cater to the demands of foreigners, overseas returnees with foreign permanent (long-term) residence permits and residents from Taiwan, Hong Kong and Macau working in Shanghai,for housing provident fund payment with an aim to attract more overseas talents to come to work or start up their own businesses in Shanghai, and provide strong support to building the talent pool for economic and social development of Shanghai. The Notice became effective as of 24 September 2015.

Notice of the Municipality on Certain Issues Concerning Expansion of HPF System Coverage to Include Foreigners, Overseas Returnees with Foreign Permanent (Long-Term) Residence Permits and Residents from Taiwan, Hong Kong and Macau Working in Shanghai

To all housing provident fund paying entities:

 

in accordance with Regulations on Management of Housing Provident Fund of the State Council and Provisions of Shanghai Municipality on Administration of Housing Provident Fund, and in light of the current situation of this Municipality, we hereby notify you of the following in a move to efficiently and comprehensively accommodate our practical measures to the new requirements of the central government for speeding up construction of Shanghai as a technology innovation center with global influence, promote more open policies on talents, and further give play to the functioning of housing provident fund system in housing security pertaining to foreigners, overseas returnees with foreign permanent (long-term) residence permits and residents from Taiwan, Hong Kong and Macau working in Shanghai:

1. On the basis of mutual discussion and agreement with the entity, a foreigner, or an overseas returnee with foreign permanent (long-term) residence permit, or a resident from Taiwan, Hong Kong, or Macau working in Shanghai who has applied for and acquired appropriate identity certificate such as residence card for an overseas talent in Shanghai (i.e. previous Type B Shanghai Residence Card), work permit for a foreigner, work permit for a resident from Taiwan, Hong Kong or Macau, certificate for sanctioned employment of an overseas returnee with foreign residence permit,and has established labor (employment) relationship with an entity in this Municipality, is eligible for housing provident fund payment as per the prevailing regulations of this Municipality, with the payment basis and the payment rate(s) determined accordingly.

 

2. Provided that a foreigner, or an overseas returnee with foreign permanent (long-term) residence permit, or a resident from Taiwan, Hong Kong, or Macau working in Shanghai dismisses or terminates the labor (employment) relationship, housing provident fund account blocking and transfer procedures shall be handled as per the current regulations of the Municipality.

 

3. Should any housing consumption occurs within this Municipality, such as home purchasing, home renting or property service charges, a foreigner, or an overseas returnee with foreign permanent (long-term) residence permit, or a resident from Taiwan, Hong Kong, or Macau working in Shanghai is entitled to proceed with housing provident fund withdrawal as per relevant regulations of this Municipality.

 

4. Regulations regarding housing provident fund loans for home purchase in this Municipality of a foreigner, or an overseas returnee with foreign permanent (long-term) residence permit, or a resident from Taiwan, Hong Kong, or Macau working in Shanghai shall be formulated separately.

 

5. Housing provident fund related personal income tax shall be proceeded in accordance with relevant tax regulations of the state.

 

6. The Notice is effective as of the issue date, for a period of five years.
